AfriCamb Terms of Service

AfriCamb provides a personalized subscription service that allows our members access to study material based on the Cambridge IGCSE level.

AfriCamb uses internet streaming to explain subject content in Afrikaans to home scholars. It is the parents' own responsibility to monitor the child’s progress. AfriCamb is not a registered school or tutoring centre. Therefore it is the parents' responsibility to register for exams at the examination centre, to pay the examination fees and to make sure that the child or students have access or transport to and from the tutoring centre. AfriCamb will not be held accountable for the progress of the students work and the outcome of the student’s examination marks. AfriCamb is a pure platform giving subject content and explanations to certain subject matters and content in Afrikaans. AfriCamb will always strive to give subject information through according to the Cambridge syllabus and will also use past examination papers and the memorandums thereof to build our classes or explanatory video content. These Terms of Service govern your use of our service/product. Terms used in these Terms of Service,like; “AfriCamb service”, “our service” or “this service”, refers to the service/product provided by AfriCamb for discovering and watching AfriCamb content, including all features and functionalities, recommendations and reviews, the website and user interfaces, as well as all content and software associated with our service/product.

1. Membership

1.1. Your AfriCamb membership will continue until terminated. To use the AfriCamb service you must have Internet access. “Payment Method” refers to a current, valid, accepted method of payment, as may be updated from time to time, and which may include payment through your account with a third party. Unless you cancel your membership before your billing date, you authorize us to charge the membership fee for the next billing cycle to your Payment Method.

1.2. We may offer a number of membership plans, including special promotional plans. Some membership plans may have differing conditions and limitations, which will be disclosed at your sign-up or in other communications made available to you.

2. Billing and Cancellation

2.1 The length of your billing cycle will depend on the type of subscription that you choose. In some cases your payment date may change, for example if your Payment Method has not successfully settled or if your paid membership began on a day not contained in a given month.

2.2. Payment Methods. Payment may be made via Visa and MasterCard. You remain responsible for any uncollected amounts. If a payment is not successfully settled, due to expiration, insufficient funds, or otherwise, and you do not cancel your account, we may suspend your access to the service until we have successfully charged a valid Payment Method. For some Payment Methods, the issuer may charge you certain fees, such as foreign transaction fees or other fees relating to the processing of your Payment Method.

2.3. Updating your Payment Methods. We may also update your Payment Methods using information provided by the payment service providers. Following any update, you authorize us to continue to charge the applicable Payment Method(s).

2.4. Cancellation. You can cancel your AfriCamb membership at any time, and you will continue to have access to the AfriCamb service through the end of your billing period. Payments are non-refundable and we do not provide refunds or credits for any partial membership periods or unwatched AfriCamb content. If you cancel your membership, your account will automatically close at the end of your current billing period. If you signed up for AfriCamb account using a third party as a Payment Method and wish to cancel your AfriCamb membership, you may need to do so through such third party, for example by visiting your account with the applicable third party and turning off auto-renew, or unsubscribing from the AfriCamb service through that third party.

2.5. Changes to the Price and Subscription Plans. We may change our subscription plans and the price of our service/product from time to time, however, any price changes or changes to your subscription plans will apply to subsequent billing cycles following notice of the changes to you.

2.6. Return and Refunds policy. AfriCamb provides a service based product, which can not be returned.

3. Africamb Service

3.1. The AfriCamb service and any content viewed through the service are for your personal and non-commercial use only and may not be shared with individuals beyond your household. During your AfriCamb membership we grant you a limited, non-exclusive, non-transferable right to access the AfriCamb service and view AfriCamb content. Except for the foregoing, no right, title or interest shall be transferred to you. You agree not to use the service for public performances.

3.2. The AfriCamb service, including the content library, is regularly updated. In addition, we continually test various aspects of our service, including our website, user interfaces, promotional features and availability of AfriCamb content. We will also from time to time upgrade our internet providers and server to accommodate our clients as much as possible. This can lead to possible downtime of our service, for which AfriCamb can not be held liable for any incurred loss of time or money.

3.3. You agree not to archive, reproduce, distribute, modify, display, perform, publish, license, create derivative works from, offer for sale, or use content and information contained on, or obtained from, or through the AfriCamb service. You also agree not to: circumvent, remove, alter, deactivate, degrade or thwart any of the content protections in the AfriCamb service; use any robot, spider, scraper or other automated means to access the AfriCamb service; decompile, reverse engineer or disassemble any software or other products or processes accessible through the AfriCamb service; insert any code or product or manipulate the content of the AfriCamb service in any way; or use any data mining, data gathering or extraction method. In addition, you agree not to upload, post, e-mail or otherwise send or transmit any material designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment associated with the AfriCamb service, including any software viruses or any other computer code, files or programs. We may terminate or restrict your use of our service if you violate these Terms of Service or are engaged in illegal or fraudulent use of the service.

3.4. The quality of the display of the AfriCamb content may vary from device to device, and may be affected by a variety of factors, such as your location, the bandwidth available and/or the speed of your Internet connection. The time it takes to begin watching AfriCamb content will vary based on a number of factors, including your location, available bandwidth at the time, the content you have selected and the configuration of your AfriCamb ready device.

3.5. This software may vary by device and medium, and functionalities and features may also differ between devices.

4. Passwords and Account Access.

The member who created the AfriCamb account and whose Payment Method is charged (the "Account Owner") has access and control over the AfriCamb account and the AfriCamb content. To maintain control over the account and to prevent anyone from accessing the account (which would include information on viewing history for the account), the Account Owner should maintain control over the AfriCamb ready devices that are used to access the service and not reveal the password or details of the Payment Method associated with the account to anyone. You are responsible for updating and maintaining the accuracy of the information you provide to us relating to your account. We can terminate your account or place your account on hold in order to protect you, AfriCamb or our partners from identity theft or other fraudulent activity.

5. Warranties and Limitations on Liability.

The AfriCamb service is provided "as is" and without warranty or condition. In particular, our service may not be uninterrupted or error-free. You waive all special, indirect and consequential damages against us.

6. Miscellaneous.

6.1. Customer Support. To find more information about our service and its features or if you need assistance with your account, please send us an e-mail to info@africamb.co.za regarding your concern or information needed.

6.2. Variation in Terms of Use and Assignment. AfriCamb may, in its sole discretion, from time to time, change these Terms of Use. We will notify you at least 30 days before such changes apply to you, unless any third parties require an immediate change in our Terms of Use. In such case changes will take effect immediately and you will be notified accordingly. We may assign or transfer our agreement with you including our associated rights and obligations at any time and you agree to cooperate with us in connection with such an assignment or transfer.

6.3. Electronic Communications. We will send you information relating to your account (e.g. payment authorizations, invoices, changes in password or Payment Method, confirmation messages, notices) in electronic form only, for example via emails to your email address provided during registration.

7. Customer Privacy Policy.

AfriCamb shall take all reasonable steps to protect the personal information of users. For the purpose of this clause, "personal information" shall be defined as detailed in the Promotion of Access to Information Act 2 of 2000 (PAIA). 8. Card Aquiring and Security

Card transactions will be acquired for AfriCamb via PayGate (Pty) Ltd who are the approved payment gateway for all South African Acquiring Banks. PayGate uses the strictest form of encryption, namely Secure Socket Layer 3 (SSL3) and no Card details are stored on the website. Users may go to www.paygate.co.za to view their security certificate and security policy.

9. Customer Details Separate from Card Details

Customer details will be stored by AfriCamb separately from card details which are entered by the client on PayGate’s secure site. For more detail on PayGate refer to www.paygate.co.za .

10. Merchant Outlet Country and Transaction Currency

The merchant outlet country at the time of presenting payment options to the cardholder is South Africa. Transaction currency is South African Rand (ZAR).

11. Responsibility

AfriCamb takes responsibility for all aspects relating to the transaction including sale of goods and services sold on this website, customer service and support and dispute resolution.

12. Country of Domicile

This website is governed by the laws of South Africa and AfriCamb chooses as its domicilium citandi et executandi for all purposes under this agreement, whether in respect of court process, notice, or other documents or communication of whatsoever nature.
